E-commerce Terms and Conditions for Klithjem Badehotel

Please note that your booking and ticket purchases are not covered by the rules on the right of withdrawal under the Danish Consumer Contracts Act. The sale of accommodation (for example hotel stays, cabins, holiday homes, etc.) is covered by a special exemption in section 18(2), no. 12 of the Danish Consumer Contracts Act. Therefore, the booking made is not covered by a 14-day right of withdrawal. The reason is that it is often not possible to re-let a reserved room/stay that is cancelled only a few days before arrival.

Terms of Sale and Delivery

Below you will find useful information regarding online booking and ticket purchases. You can read, among other things, about how we process the information you enter, how you receive your receipt in connection with a purchase, and much more.

Booking and Payment

If you book a stay or purchase tickets, the full amount is payable immediately after the booking/purchase has been completed.

Immediately after receiving the order, Klithjem Badehotel will send a confirmation/order confirmation by e-mail. If you do not receive an e-mail with your confirmation/order confirmation, please check your spam and/or junk mail folder.

Verification of Rental Certificate/Order Confirmation

Upon receipt of the rental certificate/order confirmation, it is the renter’s/buyer’s responsibility to ensure that the period and the selected unit are correct.

Cancellation Protection

With cancellation protection, you have the option to change your booking free of charge and receive a refund if you cancel your stay.

If you do not purchase one of our three cancellation protection options (Flex, Plus or Premium), you will not be able to change your booking or receive a refund. Tickets purchased for events cannot be cancelled.

Cancellation Protection Flex:
5% of the booking amount

More than 60 days before arrival:
Cancellation more than 60 days before arrival entitles you to a refund of 100% of the booking amount, less the price of the cancellation protection.

59–30 days before arrival:
Cancellation of the stay entitles you to a refund of 75% of the full amount, less the price of the cancellation protection.

29 to 0 days before arrival:
Cancellation of the stay does not entitle you to any refund.

Cancellation Protection Plus:
10% of the booking amount

More than 60 days before arrival:
Cancellation more than 60 days before arrival entitles you to a refund of 100% of the booking amount, less the price of the cancellation protection.

59–5 days before arrival:
Cancellation of the stay entitles you to a refund of 90% of the booking amount, less the price of the cancellation protection.

4 to 0 days before arrival:
Cancellation of the stay does not entitle you to any refund.

Cancellation Protection Premium:
15% of the booking amount

Cancellation up until 12:00 noon on the day before arrival entitles you to a refund of 100% of the booking amount, less the price of the cancellation protection.

During the stay:
Our 3 different cancellation protection options do not cover situations where you are forced to interrupt your stay with us. If you (for any reason) are forced to interrupt your stay, the remainder of the stay will not be refunded.

If you interrupt your stay due to acute illness, an accident, or a death in your immediate family, please note that you may be covered by your private travel insurance.

Right of Withdrawal and Refund

Please note that your booking is not covered by the rules on the right of withdrawal under the Danish Consumer Contracts Act. The sale of accommodation (for example hotel stays, cabins, holiday homes, etc.) is covered by a special exemption in section 18(2), no. 12 of the Danish Consumer Contracts Act. Therefore, the booking made is not covered by a 14-day right of withdrawal.

Dog

Dogs are welcome at Klithjem Badehotel in selected rooms. A separate charge may apply for bringing a dog.

Arrival and Departure

The room/stay can be expected to be ready at 4:00 PM and must be vacated no later than 11:00 AM.

Specific rooms cannot be guaranteed, but we will of course do our best to accommodate your wishes.

Klithjem Badehotel accepts no responsibility for the guest’s ability to make use of the stay. If, as a guest, you are prevented from travelling to or from the accommodation (for example due to cancelled flights/train departures, car problems, traffic conditions, border closures, etc.), you will not be compensated for this.

Smoking at the Hotel

Smoking in general: Please be considerate in outdoor common areas and remember that cigarette butts belong in the bin. Smoking is not permitted in indoor common areas. This also applies to e-cigarettes.

Cancellation of Events

If the event is cancelled in full, you are entitled to have your ticket refunded or exchanged for another day.

Hygiene Conditions, Including COVID-19, etc.

For hygiene reasons, some facilities may have restricted access during your stay. There may be areas that are temporarily closed or areas/facilities that will remain closed for the entire stay. This does not entitle you to a refund for part or all of your stay.

Complaints

At Klithjem Badehotel, we will do everything we can to make your stay something truly special. However, mistakes can always occur, and if there is anything you as guests are dissatisfied with, you must contact the reception as soon as possible. Complaints regarding, for example, cleaning that are only raised at departure will not be processed.

Klithjem Badehotel cannot be held responsible for the presence of animals and insects, as the accommodation is located in a natural area.

Please note that Klithjem Badehotel is located near a military training area, which means that noise disturbances may occur.

If you wish to submit a complaint after returning home, you may write to us by e-mail no later than 7 days after departure at: info@klithjembadehotel.dk

In the event of disagreement, any legal proceedings shall be brought before the Court in Esbjerg, and cases shall be decided under Danish law.

Data Protection

In accordance with data protection legislation, Klithjem Badehotel is the data controller. Any inquiry regarding data protection must be made in writing to: DPO@hvidbjerg.dk

Klithjem Badehotel processes the personal data provided by the renter in connection with the booking because this is necessary in order to complete the order and thereby also fulfil the agreement, as well as to comply with any other obligations arising from the agreements entered into between Klithjem Badehotel and the renter.

As the renter, you are at all times entitled to object to the processing of your personal data for these purposes.

Klithjem Badehotel discloses, to the extent necessary, relevant information contained in this agreement to business partners (for example cleaning companies, credit card companies, insurance companies, and public authorities) in order to complete the rental, collect correct and secure payment, or to the extent necessary under the legislation applicable at any given time.

Klithjem Badehotel only transfers personal data to countries outside the EU/EEA to the extent necessary and only where appropriate safeguards exist to ensure an adequate level of protection in accordance with the legislation applicable at any given time.

Personal data is stored only for the period necessary in relation to the relevant purpose or in accordance with applicable law.

Klithjem Badehotel receives e-mail addresses from Facebook, collected with users’ consent through advertisements, so that they can receive newsletters. The information is used solely in connection with the distribution of newsletters, and consent can always be withdrawn by unsubscribing via the link in the newsletter.

As a data subject, the renter has the right to be informed about – and receive a copy of the data – that Klithjem Badehotel has registered, and to have such information/data corrected or amended if it proves to be inaccurate. The renter also has the right to have information/data deleted if it is no longer necessary to fulfil the purpose for which it was collected, or if the processing is unlawful. Finally, the renter has the right to request that Klithjem Badehotel restrict the processing of the data in question.

Klithjem Badehotel uses server-side cookies and a secure connection to ensure the security of the information you as a guest provide on our website.

When paying by credit card, registration takes place via a secure server, where the information is encrypted before being sent over the internet.

Prices and Discounts

Prices at Klithjem Badehotel are adjusted on an ongoing basis, and current prices can be found on our website. We reserve the right to cancel an agreement due to typing errors and/or printing errors. Discounts cannot be combined.

Force Majeure and Similar Circumstances

If performance of the agreement is not possible – or is materially impeded – as a result of force majeure or circumstances equivalent thereto, including but not limited to: war, riots, natural disasters, oil and petrol rationing, pollution disasters, epidemics, pandemics, suspension of foreign exchange trading, unusual weather conditions, drought, flooding, border closures, traffic conditions, strikes, lockouts, and similar circumstances that could not be foreseen when the agreement was entered into, Klithjem Badehotel is entitled to cancel the agreement, and Klithjem Badehotel cannot be held liable in such cases.

In such cases, Klithjem Badehotel is obliged to notify the renter as soon as possible. The renter is not entitled to repayment of amounts paid. However, the renter will receive a voucher for the amount paid. The voucher may be used to purchase a new stay within a period of 3 years.
